NSW EPA Underground Petroleum Storage Systems Update No. 8




On 1 September 2019 NSW Councils resumed responsibility for regulating most underground petroleum storage systems (UPSS) in their local areas. 

The EPA remains the regulator for around 1000 UPSS sites which hold a EPA licence, are operated by a public authority, are in unincorporated areas of the state or are subject to a regulatory notice that we have already issued to a UPSS site.

Renewal of exemption order for UPSS used for back-up generators, heating oil and waste oil (Class 1 Exemptions)

The exemption for persons responsible for UPSS that are used to store heating or waste oil, or fuel for a back-up generators has been extended to 31 August 2021. An exemption for these types of UPSS sites has existed since the commencement of the original regulation on 1 June 2008.

The ongoing exemption allows for the transition of responsibility for other types of UPSS to councils from 1 September 2019 and to allow the EPA to conduct a review and risk assessment of these types of UPSS to better inform any future decision making to best manage and/or regulate them. The exemption order was published in the NSW Government Gazette No 98 on 30 August 2019.
